MSME Direct (hereinafter, referred to as “we,” “our,” “us”, “MSME Direct”) takes data privacy seriously. We recognise and value the trust that our prospective clients, clients, service providers, vendors, suppliers, and individuals place in us when providing us with personal data and we are committed to safeguarding the privacy and security of personal data we may collect from our clients, service providers, vendors, suppliers, and individuals / other entities to whom we provide our services. This data privacy and protection policy is published to fulfil our obligations under applicable privacy laws in India. The applicable privacy laws are as follows:

  2. Digital Personal Data Protection Act, 2023 (as applicable).

We are a unique platform dedicated towards facilitating connections between you and the service providers. Our website and/or mobile application serves as a bridge, allowing you to efficiently search for relevant services while connecting you with the right service providers.

We may collect and process different types of personal data of our prospective clients, clients, vendors suppliers and service providers in the course of operating our business and providing our services. These include:

  • Basic personal details such as your name, gender, age, location;
  • Contact data such as your telephone number and postal or email address;
  • Financial data such as payment related information or bank account details;
  • Website and/or mobile application usage and other technical data such as details of your visits to our website(s) and/or mobile application;
  • Password used for during registration or sign-up process into the website and/or mobile application; and/or

During registration or sign-up process, you may be required to provide relevant organizational data including the organization’s name, type, and business category, as well as details on its MSME classification, description of specialization, years of experience, and contact information such as phone number, address, and email address. Additionally, you may be required to identification numbers such as the GST number, PAN number, and Udyam Aadhar number, alongside the relevant government issued identification documents.

3. How we obtain the personal data about you

We may collect or receive your personal data in a number of different ways:

  • Where you provide it to us directly, for example by corresponding with us by email, or via other direct interactions with us such as completing a form on our website and/or mobile application or registering for our updates and newsletters;
  • Where we monitor use of, or interactions with, our websites and/or mobile application, any updates or newsletters we may send to you, or other email communications sent from or received by us;
  • Where we receive information about you during the course of our engagement with you while providing our services; or
  • Publicly available sources - we may, for example, use publicly available sources to help us keep the contact details we already hold for you accurate and up to date or for professional networking purposes, e.g. LinkedIn or social media like Facebook and Twitter.

4. How we use your personal data

We will only use your personal data where we are permitted to do so by applicable law and after obtaining your consent to use such personal data.

Consent: where you have consented to our use of your personal data and information (by visiting our website and/or mobile application, and/or signing up for our services you have consented to the collection, use, processing, and storage of the data and personal information provided to us by you. Further, you may choose to withdraw your consent, at any time, by writing to us at the contact information provided in section 11 (hereinbelow). In case you choose to withdraw your consent according to the privacy policy, we may restrict/limit your access to the website and/or mobile application.

We may use your personal data in the following ways. In each case, we note the grounds that we rely on to use your personal data.

  • To provide our services to you and to conduct our business: to administer and perform our services including to register you for an account, connect you with the service providers, facilitate communication between you and service providers, and process transactions as well as to respond to your questions, requests, or inquiries, including to provide support and troubleshooting assistance;

We may also process your personal data to comply with our regulatory requirements or in the course of dialogue with the regulators as applicable, which may include disclosing your personal data to government, regulatory or law enforcement agencies in connection with enquiries, proceedings or investigations by such parties anywhere in the world or where compelled to do so.

6. How do we transfer your personal data

We impose strict data protection safeguards and implement appropriate measures to ensure that your personal data is protected in accordance with applicable data protection laws. You are responsible for ensuring the protection of login and password records for your account.

7. How long we keep your personal data

We will retain your personal data for as long as is necessary to fulfill the purpose for which this data was collected and any other permitted linked purpose. If your personal data is used for two purposes we will retain it until the purpose with the latest period expires, but we will stop using it for the purpose with a shorter period once that period expires. Our retention periods are also based on our business needs and good practice. However, we may retain data related to you if there is a legal obligation to retain such data.

We recognise that information security is an integral element of data privacy. While no data transmission (including over the Internet or any website) can be guaranteed to be secure from intrusion, we implement a range of commercially reasonable physical, technical and procedural measures to help protect personal data from unauthorised access, use, disclosure, alteration or destruction in accordance with data protection law requirements. Our website and/or mobile application may contain links to other websites that may collect information from you. We are not responsible for the privacy practices or the content of those linked websites.

9. What rights you have in relation to your personal data

If you have any questions about our use of your personal data, you should first contact us via the details provided in section 11 hereinbelow. You have the option, provided by your mobile device operating system to discontinue our ability to collect stored information or location information via our mobile application. If you choose to limit this, you may not be able to access certain features of the mobile application. Under certain circumstances and in accordance with applicable data protection laws, you may have the right to require us to:

  • provide you with further details on the use we make of your information;
  • provide you with a copy of the personal information that we hold about you;
  • complete and update any inaccuracies in the personal data we hold;
  • delete any personal data that we no longer have a lawful ground to use;
  • nominate a person as specified by you to exercise the rights mentioned section 9 herein, in the event of your death or incapacity.
  • to withdraw your consent at any time (as applicable) so that we stop the use of your personal data with immediate effect; and
  • restrict how we use your information whilst a complaint (if any) is being investigated.

10. How we use cookies and similar technologies

When you visit our websites and/or mobile application, we may send a cookie to your computer. This is a small data file stored by your computer to help improve functionality or tailor information to provide visitors with more relevant pages. We may also analyse website and/or mobile application traffic to identify what visitors find most interesting so we can tailor our websites and/or mobile application accordingly.

We may change the content of our Data Privacy and Protection Policy, our websites and/or mobile application and how we use cookies without notice in the future. Further, we shall periodically update and revise this Data Privacy and Protection Policy as and when the need arises or when there is a change in applicable law.
